LENYENYE: Defence Lawyer, Advocate Makwela is applying bail for rape accused, Masilo Philemon Sebashe at the Lenyenye Magistrate’s Court.
▪︎ Defence Lawyer says the court should look in the best interest of the accused but also the victim.
▪︎Defence Lawyer says the accused is a breadwinner and should he continue to be incarcerated, his family will suffer.
▪︎The accused is married for a period of 10 years and has three children. He has fixed property.
▪︎The defense lawyer says the accused has no intention to leave the country so he is not a flight risk. He is well known in the community as he is a business man.
▪︎The defence lawyer says the accused is not a trouble maker and he intends to plead not guilty.
▪︎He says should the accused be given bail, he wil go stay at Moime at his in laws and he will not interfere with investigations.
▪︎The defence lawyer says he pleads with the court to release him on bail as he is innocent until he is proven guilty.
▪︎Defence lawyer says if the court grants bail, the bail amount should not be exuberant.
▪︎He argues that Tzaneen FCS employee, Sergeant Mohlaba answered with long questions that have nothing to do with the case.
▪︎He says they concede that the accused is facing a rape case but that doesn’t mean he shouldn’t get bail.
▪︎The defence lawyer says the investigating may take months and in the meantime, the accused will be suffering behind bars.
▪︎The defence lawyer says he apologizes on behalf of the accused for his attempt to show his display his penis before the court.
▪︎The accused has posed R2 000 for bail.
