Tlhabine rape accused Matome Philemon Sebashe denied bail

LENYENYE-39 – year-old male suspect who is accused of the rape of a five-year-old girl has been denied bail.

Masilo Philemon Sebashe appeared before the Lenyenye Magistrate’s Court in Greater Tzaneen today.

The Magistrate said that it would not be in the interest of justice to release the accused on bail.

The wife, Thandi and uncle, Petrus Sebashe took the stand and were cross-examined by both the defence and the state when the matter was sent for section 77 of the Criminal Procedure Act after the suspect displayed his genitals in full view of the court on Thursday during the bail application.

The Magistrate said that the accused did not provide exceptional reasons for him to be released on bail. He said that even though the accused is a breadwinner, his three kids and his logistic business can survive as his three workers can carry on with the day-to-day running of the business.

He said that evidence from the doctor’s medical examination proves that there was penetration in the victim’s genitalia.

The suspect will remain in custody and will return to court on May 31st and the investigations continue.

The court will also await DNA which is expected to take two to three months as well as the testimony of the social worker.
