LENYENYE: The Lenyenye Magistrate’s Court is today conducting section 77 of the Criminal Procedure Act in the case involving rape accused, Masilo Philemon Sebashe.
This was prompted by the accused showing his genitals in full view of the court on Thursday during the bail application.
Section 77 of the Criminal Procedure (Act 51 of 1977 ) (‘the CPA’) deals with the treatment of an accused who is unfit to stand trial due to a mental illness or intellectual disability (the generic term ‘mental disability’ will be used to refer to both types of mental condition, except where it is necessary to.
The 39 – year old is applying for bail after he was slapped with a rape charge of a 5 – year old girl that he was allegedly transporting from school to home at the beginning of the month.
The wife and uncle of the accused will be cross – examined by the State and the defence.
