Man sentenced to Life Sentence for Assaulting, Kidnapping, and Raping ex-girlfriend at Magau village


MAKHADO-The Makhado Regional Court in the Vhembe District handed down a life sentence to a 42-year-old man on Wednesday, June 26, 2024, for charges including assault with intent to cause grievous bodily harm (GBH), kidnapping, and rape.

The court heard that on May 7, 2023, the accused encountered the victim at Magau village in the Tshilwavhusiku policing area and forcibly compelled her to accompany him to his home. When the victim resisted, the accused struck her on the head with a hammer, forcing her to walk to his residence where he repeatedly raped her. Despite the severe head injury and excessive bleeding, the victim was only released the following day and immediately taken to a hospital for medical treatment.

The victim, who had a protection order against the accused—her ex-boyfriend—reported the incident to the Tshilwavhusiku police. The case was then transferred to the Makhado Family Violence, Child Protection, and Sexual Offenses (FCS) unit for further investigation.

Warrant Officer Lufuno Mutheiwana led the investigation, diligently tracking down the suspect, who had fled after the incident. The accused was apprehended a week later and remained in police custody after multiple failed attempts to secure bail, opposed by the investigating officer.

On June 26, 2024, the court convicted the accused on all charges and sentenced him as follows:

Rape: Life imprisonment

Assault with intent to cause grievous bodily harm (GBH): Ten years imprisonment

Kidnapping: Fifteen years imprisonment

Lieutenant General Thembi Hadebe, the Provincial Commissioner of the South African Police Service in Limpopo, commended the diligent efforts of the investigating officer and the team involved in ensuring that justice was served for the victim of gender-based violence.
